Just a decade ago, the Tenth Amendment was being diagnosed as on its' death bed and terminally ill. The expansion of the use of the Commerce and General Welfare Clauses had pushed the Tenth Amendment to near extinction. Today, the last stand of the rights of the states is enjoying a vigorous and robust rebound.
Across the nation, states are turning to the Tenth to stave off the encroachment of the federal government into territories once considered the sole domain of the states, such as healthcare and identification. The trend began with the state-level legislation to refuse implementation of the REAL ID Act of 2005 and quickly lead to the drafting of numerous Sovereignty Resolutions. Now, the next step has been taken on the road to recovery by the Tenth with the wave of Healthcare Freedom Acts currently being pursued in approximately 30 statehouses across the country.
