District Attorney Won't Prosecute All Gun Laws

Jackson County District Attorney Gerald Fox says he will not prosecute some gun laws in the wake of a U.S. Supreme Court decision. Fox said last week's court ruling "immediately renders some of Wisconsin's current laws unconstitutional, " and his office will no longer accept certain law enforcement referrals for violations including carrying a concealed weapon.
"They said from now on - because of the Second Amendment - protection is a fundamental right, " Fox said. "That applies throughout the land, and self-defense is at the core of the Second Amendment
"Any law that infringes or impedes that right ... is unconstitutional."

The Supreme Court's 5-4 vote July 28 in McDonald v. City of Chicago struck down the city's 28-year-old ban on firearms, ruling that such laws violate the Second Amendment's right "to keep and bear arms." The decision also held the Second Amendment restrains the government's ability to significantly limit that right.
